INFORMATIVA ISCRIZIONE ALLA NEWSLETTER IN MATERIA DI PROTEZIONE DEI DATI PERSONALI AI SENSI DELL’ART. 13 D. LGS. 30.06.2003, N. 196

INFORMATION SUBSCRIPTION TO THE NEWSLETTER ON THE PROTECTION OF PERSONAL DATA PURSUANT TO ART. 13 OF LEGISLATIVE DECREE 196/2003, N. 196

Ai sensi dell’art. 13 del D. Lgs. 196/2003 la società P.E.A. COSTRUZIONI S.R.L. con sede in Via XX Settembre 27, 95027 San Gregorio di Catania (CT), in qualità di Titolare del trattamento, informa gli interessati su quali siano le finalità e modalità del trattamento dei dati personali raccolti, il loro ambito di comunicazione e diffusione, oltre alla natura del loro conferimento.

Pursuant to art. 13 of Legislative Decree 196/2003, the society P.E.A. COSTRUZIONI S.R.L. based in Via XX Settembre 27, 95027 San Gregorio di Catania (CT), as Data Controller, informs those concerned about the purposes and methods of processing personal data collected, their sphere of communication and diffusion, and the nature of their contribution.

FINALITA’. I dati personali identificativi e informatici, raccolti presso gli interessati, oggetto del trattamento, sono utilizzati direttamente per adempiere alla richiesta di invio della newsletter e relativa iscrizione nella mailing list, avente ad oggetto messaggi informativi e comunicazioni commerciali e promozionali relativi all’attività svolta dal Titolare, nel completo rispetto dei principi di liceità e correttezza e delle disposizioni di legge.

PURPOSES. The personal identification and IT data collected by the data subjects, object of the treatment, are used directly to fulfil the request for sending the newsletter and its registration in the mailing list, concerning informative messages, commercial and promotional communications relating to the activity carried out by the Owner, in full compliance with the principles of lawfulness and correctness and the provisions of the law.

MODALITA’ DEL TRATTAMENTO. Il trattamento dei dati è eseguito attraverso supporti cartacei, informatici e telematici ad opera di soggetti interni appositamente incaricati. I dati sono conservati in archivi elettronici e, in via residuale, cartacei con piena assicurazione delle misure di sicurezza minime previste dal legislatore.

METHOD OF TREATMENT. The processing of data is carried out through paper, computerized and telematic supports by internal individuals specifically appointed. The data are stored in electronic files and, in a residual manner, on paper with full assurance of the minimum security measures provided for by the legislator.

COMUNICAZIONE E DIFFUSIONE. I dati raccolti non saranno oggetto di divulgazione e di diffusione. La comunicazione a terzi, diversi dal Titolare, dai responsabili, interni ma anche esterni alla struttura aziendale, e dagli incaricati al trattamento individuati e nominati ex artt. 29 e 30 del D. Lgs. 196/2003 e s.m.i., è prevista, ove necessaria per le finalità di cui sopra, a soggetti terzi (quali società di fornitura e assistenza informatica) impegnate nel corretto e regolare perseguimento delle finalità descritte. In ogni caso il trattamento da parte di soggetti terzi avverrà secondo correttezza e nel rispetto delle disposizioni di legge vigenti.

COMMUNICATION AND DISSEMINATION. The data collected will not be disclosed and disseminated. Communication to third parties, other than the Data Controller, the managers, internal or external to the company structure, and the appointed data processors mentioned ex the art. 29 e 30 of Legislative Decree 196/2003 and s.m.i., is provided, where necessary for the purposes mentioned above, to third parties (as supply companies and IT support) involved in the correct and regular pursuit of the purposes described. In any case, processing by third parties will be carried out according to correctness and in compliance with the provisions of the law in force.

DIRITTI DELL’INTERESSATO. L’interessato potrà far valere i propri diritti come espressi dall’artt. 7, 8, 9 e 10 del D. Lgs. 30 giugno 2003 n. 196, rivolgendosi al titolare del trattamento. In particolare secondo l’art. 7 l’interessato potrà ottenere la conferma dell’esistenza o meno di dati personali che lo riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile. L’interessato ha diritto di ottenere: a) l’aggiornamento, la rettificazione ovvero, quando vi ha interesse, l’integrazione dei dati; b) la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati; c) l’attestazione che le operazioni di cui alle lettere a) e b) sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato. L’interessato ha diritto di opporsi, in tutto o in parte: a) per motivi legittimi al trattamento dei dati personali che lo riguardano, ancorché pertinenti allo scopo della raccolta; b) al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione commerciale.

RIGHTS OF THE INTERESTED PARTY. The interested party can assert his rights as expressed in the art. 7, 8, 9 e 10 of Legislative Decree 196/2003, by contacting the data holder. Pursuant to the art. 7 the interested party may obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form. The interested party has the right to obtain: a) data updating, correction or integration, if he’s interested in them; b) la cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those that do not need to be kept for the purposes for which the data were collected or subsequently processed; c) the attestation that the operations referred to in letters a) and b) have been made known, also regarding their content, by those to whom the data have been communicated or disseminated, except in the case where this fulfillment proves impossible or involves a use of means manifestly disproportionate to the protected right. The interested party has the right to object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning him, even if they are relevant to the purpose of the collection; b) to the processing of personal data concerning him for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.

TEMPI DI CONSERVAZIONE. I dati sono conservati fino alla richiesta dell’interessato di eventuale opposizione all’invio e alla volontà di questi di rinunciare alla ricezione della newsletter tramite le modalità messe a tal fine a disposizione periodicamente.

PRESERVATION TIME. The data are kept until the person concerned takes position against the sending of the newsletter and he gives away the receipt of the newsletter through the methods periodically provided for this purpose.

NATURA DEL CONFERIMENTO. Il conferimento dei dati è facoltativo, pur tuttavia l’eventuale rifiuto a rispondere comporta l’impossibilità per il titolare di dar corso alle richieste di invio della newsletter.

NATURE OF THE CONFERMENT. The conferment of data is optional, but any refusal to reply implies the impossibility for the owner to process the requests for sending the newsletter.

CONSENSO. Ai sensi dell’art. 23 del D. Lgs. 196/2003 il consenso al trattamento dei suddetti dati è necessario. Il consenso si considera prestato con la richiesta di iscrizione alla newsletter.

CONSENT. Pursuant to art. 23 of Legislative Decree 196/2003, consent to the processing of the above-mentioned data is necessary. The consent is considered granted with the request for subscription to the newsletter.
